Anti Spam Policy

This Anti-Spam Policy sets out the terms between EQUP of 3901 North Federal Highway Suite 201, Boca Raton, Florida, Zipcode 33433, United States(hereinafter referred to as "we" or "EQUP") upon which you may use our Platform and Services. Your use of our Platform and Services means that you accept, and agree to abide by (and shall ensure that all users of your account on the Platform and Services, whose acts carried out on your account shall deemed to be an act carried out by you, shall abide by), all the policies in this Anti-Spam Policy, which form part of and supplement our main Terms of Service (the “Terms”). We, at EQUP believe that any email or other solicitation must be legitimate and expected by their intended recipient. You agree to EQUP Anti-Spam Policy as a precondition to user EQUP services. If we discover that you are using EQUP services for sending emails to people without their permission, we reserve the right to terminate your account.

Terms of use

    1. in any way that breaches any applicable local or international laws or regulations;
    2. in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
    3. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
  1. You must have permission from the recipient to whom you are sending the email. Along with this you must have proof of the fact that you received permission from the recipients.
  2. Email Addresses that you have bought, loaned, rented or in any way acquired from a third party are strictly prohibited. You must also refrain from importing these to your EQUP account.
  3. You must ensure that the routing and header information including your emails “From” and “To,” the originating domain name and email address are true and accurate.
  4. Subject line of your email must not be misleading. And you must not use any misleading or false name, address, email address.
  5. You must provide an unsubscribe option in every email you are sending. And you must refrain from sending email to recipients who have already unsubscribed from your mailing list.
  6. You should include a valid physical address in all emails.
  7. You must have consent from your recipients considering following points:
  8. Recipient has to check a checkbox for subscribing to your mailing list and this checkbox can’t be pre-checked or submit a form that clearly mentions for what purpose you are submitting this form.
  9. The recipient must know what kind of emails they are receiving and for what purpose.
  10. You can't use one checkbox for multiple purposes such as newsletter, marketing email, privacy policy etc. Every purpose must have a separate checkbox, so recipients can choose what kind of emails they want to receive.
  11. You must have proof of consent from the recipient, so in case if required you can show it.
  12. You must not send emails in violation of the CAN‐SPAM Act or any other applicable anti‐spam law or regulation.

Suspension and Termination

  1. We will determine, in our discretion, whether there has been a breach of this Anti-Spam Policy through your use of our Platform and Services. When a breach of this policy has occurred, we may take such action as we deem appropriate.
  2. Failure to comply with this Anti-Spam Policy constitutes a material breach of the terms of use upon which you are permitted to use our Platform, and may result in our taking all or any of the following actions:
    1. immediate temporary or permanent withdrawal of your right to use our Platform and Services;
    2. issuance of a warning to you;
    3. legal proceedings against you for reimbursement of all costs on an indemnity basis (including but not limited to reasonable administrative and legal costs) resulting from the breach;
    4. further legal action against you; and/or
    5. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
  3. We exclude liability for actions taken in response to breaches of this Anti-Spam Policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Changes to the Anti-Spam Policy

We may revise this Anti-Spam Policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this Anti-Spam Policy may also be superseded by provisions or notices published elsewhere on our Platform.
